Why the Cloud Act changes everything for a European SME

The Cloud Act is the 2018 US law that requires any company under US jurisdiction to hand over the data it holds to American authorities on a simple subpoena — even if that data is stored in Europe, and even if you are a small French company. On 5 December 2024, OpenAI transmitted 5.2 million lines of chat history to the US Department of Justice. On 18 June 2024, Anthropic did the same. No European company was notified.

Frequently asked questions

Is Profound really subject to the Cloud Act?

Yes. Profound is a US legal entity (Delaware C-corp, headquartered in New York), and therefore subject to the Cloud Act 18 U.S.C. § 2703. Even if Profound stores your data in Europe via AWS Frankfurt, the Cloud Act applies because the legal entity is American. Source: Profound Terms of Service Section 14.

Can I easily export my data from Profound?

Does Profound support Mistral?
